ARTICLE 1: DEFINITIONS

1.1. The following definitions apply in these General Terms and Conditions:
​
Event: the sporting event Masters & Teens Throwdown to be organized by or on behalf of "Stichting Girls Behind Bars" in any year.
Participant: the natural person who has registered for participation in the Event in a manner permitted by the Organizer.
Agreement: the agreement aimed at the participation of the Participant in the Event.
Organizer: the legal person (in these "Stichting Girls Behind Bars") with whom the Participant has entered into an Agreement.
1.2. These terms and conditions apply to every Agreement. The applicability of any general terms and conditions (under whatever name) of the Participant is expressly rejected.

ARTICLE 2: PARTICIPATION
​
2.1. A Participant must at least have reached the minimum age of 12 years determined by the Organizer for that Event on the day on which the Event is held, unless otherwise stipulated by the Organizer. Every person under the age of 18 must have permission and be accompanied by his / her parents who has legal custody over the Participant.

2.2. The Participant may only participate in the Event if he has fully and truthfully completed the registration form, if the registration fee for the Event has been paid in full, if the Liability Waiver form has been signed and if the Participant has agreed to the terms and conditions.

2.3. All payments are final. No (partial) refunds will be permitted, regardless of reason

2.4. The Organizer of the Event can decide on the grounds of exceptional circumstances (such as force majeure) to cancel or stop the Event or move it to another date and / or location.
​
2.5. The Organizer of the Event can change the content, start time, date and / or location of the Event.
​
2.6 The Organizer's decision not to let the Event through, to change it, to stop it or to relocate it to another date and / or location does not give the Organizer any liability for reimbursement of the costs incurred by the Participant in relation to the Event, of whatever nature.

ARTICLE 3: LIABILITY
​
3.1. Participation in the Event is at your own risk. The Organizer is not liable and accepts no liability for any damage, whatever its name or nature, that the Participant may suffer as a result of participating in the Event.
​
The Organizer is also not liable and the Organizer does not accept any liability for loss, theft or damage to property or items and / or damage to other things by the Participant and / or (other) third parties, unless this damage is the direct result of the responsibility of the Organizer, calculate intent or gross negligence. This exclusion of liability also applies to serious damage types such as all possible types of damage in connection with injury, illness or death resulting from participation in the Event.

3.2. If, despite the provisions of the first paragraph of this article 3, liability of the Organizer for damage of the Participant has to be assumed, the obligation of the Organizer to compensate that damage is at all times limited to no more than the amount that the insurer of the Organizer pays for the damage in the appropriate case.

3.3. The Participant must be adequately insured against the risk of damage that he / she or partner, family and / or friends and / or (a) surviving relative (s) might suffer as a result of his death, injury or illness caused by or caused during his participation in the Event.

3.4. The Participant declares that he / she is aware of the fact that participation in the Event requires good health in both a psychological and physical sense, and declares that he meets this requirement and that he has sufficiently prepared for the Event by training and otherwise.

3.5. The Participant indemnifies the Organizer against liability for damage that third parties may suffer as a result of actions or omissions attributable to a Participant with regard to (participation in) the Event. The Participant must be adequately insured against the risk of liability for said damage. At the first request of Organizer, Participant will provide Organizer with a copy of the relevant policy.

3.6. The Participant indemnifies the Organizer against liability for damage that a third party might suffer as a result of the Participant's participation during his participation in the Event, unless this damage is the direct result of a set-up or gross negligence attributable to the Organizer.

ARTICLE 4: PORTRAIT AND IMAGE DUTY
​
Participant grants advance permission to the Organizer for publication and reproduction of photos and images and / or audio material and such made during or around the Event, on which the Participant is visible and / or audible. This also includes the (re) use of these images and / or recordings in (advertising) expressions of or on behalf of third parties.

ARTICLE 5: PERSONAL INFORMATION

The personal data provided by a Participant is recorded by the Organizer in a file. By participating in an Event, a Participant's permission grants the Organizer to process and use the personal data for sending information to the Participant and for providing the personal data used for sending information to the Participant. By entering into the Agreement, the Participant grants permission to the Organizer to publish and reproduce his name and competition results as well as the use of the images and recordings referred to above in Article 4, for example by means of publication in newspapers and via the internet. The privacy statement of the Organizer also applies to the processing of personal data by or on behalf of the Organizer.

ARTICLE 6: APPLICABLE LAW AND CHOICE OF FORUM
​
6.1 These General Terms and Conditions as well as participation in the Event and all rights and obligations arising therefrom are governed exclusively by Dutch law.
​
6.2 All disputes arising from these general terms and conditions, the agreements arising therefrom and participation in the Event will in the first instance be settled exclusively by the competent court in the Netherlands.
​
